4. User commitments and obligations

Users of the platform (hereinafter "users" or "clients") are informed and accept that the formalization of the contract between the parties entails the commencement of a service provision relationship with SYNAPSALE, S.L. (hereinafter, SYNAPSALE). By acquiring the status of clients as a result of contracting the service, they undertake to use the platform, its services and content without infringing applicable law, good faith and public order.

Use of the platform for unlawful or harmful purposes is prohibited, or in any way that could cause damage or prevent its normal operation. With respect to the platform's content, the following is specifically prohibited:

• Its reproduction, distribution or modification, in whole or in part, without authorization from the party responsible for the platform.
• The infringement of the rights of the service provider as the legitimate owner.
• Its use for commercial or advertising purposes.

When using the platform, users undertake not to engage in conduct that may damage SYNAPSALE's image, interests and rights or those of third parties, or that may damage, disable or overload the platform and prevent its normal use.

Users must be aware that security measures for networked computer systems are not completely reliable and that SYNAPSALE cannot guarantee the absence of malware or other elements on the network that may cause alterations in users' computer systems (software and hardware) or in their electronic documents and files, even if the appropriate means and security measures have been implemented to prevent the presence of such harmful elements.

5. Intellectual and industrial property

SYNAPSALE is the legitimate holder, or holds the appropriate licenses, in relation to the intellectual and industrial property exploitation rights associated with the platform and the content included therein, including texts, logos, trademarks, photographs, illustrations, drawings, graphics, designs or any other type of content.

Access to and use of the platform do not imply the transfer, waiver or assignment, in whole or in part, of SYNAPSALE's rights as the owning company. Users have a right of use with respect to the platform's content only in accordance with this Legal Notice and the general terms and conditions of contracting.

Registered trademarks, trade names or distinctive signs, whether registered by SYNAPSALE or by third parties, may not be used without the consent of their legitimate owners, and mere access to the platform does not grant users any rights over the content included therein.

The content included in the platform may not be modified, copied, reproduced, published, transformed or distributed without authorization, for public or commercial purposes and by any means.

The identifying data of the owners of the platform's content, nor the protection mechanisms incorporated therein, may not be removed, tampered with or modified.

Users shall be responsible for any information sent through the contact means and channels enabled by the platform. They warrant that they have the right to do so and that they do not infringe third-party intellectual and industrial property rights, that the information transmitted is not confidential and does not entail any breach of professional secrecy nor any harm to third parties.

Users shall be responsible for the accuracy, legality and ownership of any communication made through the interaction means provided on the platform and undertake to immediately notify the existence of any illegal or unlawful content of which they become aware that may constitute an infringement of SYNAPSALE's or third parties' intellectual property rights.

Users who consider that their intellectual or industrial property rights are being infringed by any content on the platform may contact SYNAPSALE by sending an email to admin@synapsale.com and providing the claimant's identity, documentary evidence of ownership, a description of the infringement committed and the absence of authorization for the use of the rights.

6. Security measures

Personal data that may be communicated by platform users may be stored in automated or non-automated databases, which are exclusively owned by SYNAPSALE. Technical, organizational and security measures have been adopted to ensure the confidentiality, integrity and quality of the information contained therein, in accordance with the applicable data protection regulations in force.

Communication between users and the platform uses a secure channel and transmitted data are encrypted through secure protocols, ensuring the best security conditions to protect user confidentiality.

7. Links to third-party channels and/or websites

The platform may provide links to other sites, web pages, channels and content owned by third parties. The purpose of these links is to offer utility to users and facilitate access to sites or networks related to agreements and collaborations between SYNAPSALE and other entities or companies. SYNAPSALE shall not be responsible for the results derived from access to such links when the sites are managed by third parties.

The information provided through such links is subject to the specific privacy policies of the linked websites, social networks and channels; therefore, it is recommended to review their corresponding policies in detail.

Any link from other sites to the platform shall require SYNAPSALE's prior express and formal authorization as the holder and owner of the platform.

8. Links to social networks

The platform may provide users with linking tools to access third-party platforms and social networks (Facebook, LinkedIn, Twitter, Instagram, YouTube, etc.).

Such functionalities do not imply the existence of a commercial relationship between SYNAPSALE and such platforms, nor SYNAPSALE's acceptance or approval of their content and services; the owner of such networks is responsible for them.

SYNAPSALE will not share users' personal data or confidential information with third-party platforms and social networks. Each user will be responsible for the information they wish to provide to such platforms or networks.

Access to platforms and social networks may involve identification and authentication processes that are unrelated to SYNAPSALE and beyond its control, so the company shall not be responsible for their security configuration nor for failures or vulnerabilities in their environment.

Users acknowledge and accept that SYNAPSALE shall not be responsible for the content and services they access on such platforms and social networks, including advertising or promotional content, and users shall be responsible for their use and for any information of their own or of third parties that they share on their own initiative.

9. Links from third-party channels and/or websites

SYNAPSALE does not authorize the establishment of links to this website from pages, channels or sites containing unlawful or illegal information or content, or any content contrary to law, morality, public order or generally accepted social norms.

Links to the platform from pages, channels or sites managed by third parties are subject to SYNAPSALE's prior approval. Given the impossibility of controlling all information and services included on linked sites or channels, SYNAPSALE assumes no responsibility for their content, products or services and reserves the right to terminate any agreement related to links when it considers that they breach the conditions indicated, infringe the company's interests or are incompatible with its purposes.

10. Use of profiles on social networks

SYNAPSALE informs users about the rights and obligations of users who visit the official profiles that the company may have on social networks such as Facebook, LinkedIn, Twitter, Instagram, etc.

SYNAPSALE shall not be responsible for users' actions in situations related to their interaction through such profiles, and users must assume the liabilities arising therefrom, in particular with respect to:

• Information published on social networks that has not been shared by SYNAPSALE or that originates from third parties.
• The lack of operability of a social network due to technical causes attributable to its owner, to third parties or to force majeure.
• Modifications to the terms of use and privacy policies of social networks made by the network itself.
• Publication of defamatory, insulting, discriminatory content that incites violence or is contrary to law, morality or public order.
• The introduction of viruses or malicious code by users.

SYNAPSALE undertakes to remove any content accessible on its social network profiles that is contrary to applicable regulations, immediately and as soon as it becomes aware of the situation.

SYNAPSALE may warn and take measures to suspend, expel or block users who send or disseminate inappropriate content, and may prevent the use of the social profile indefinitely in cases of repeated behavior.

SYNAPSALE does not guarantee the truthfulness, reliability, validity or integrity of third-party content uploaded to its social network profiles and does not necessarily identify with their opinions, recommendations or statements. Users shall be responsible for assessing the published information and for assuming the consequences of decisions adopted on the basis thereof.

SYNAPSALE will use its official profiles to disseminate its activities and to inform about events, projects, acts and matters of general interest.

11. Dispute resolution platform

SYNAPSALE makes available to users information on the dispute resolution platform provided by the European Commission and available at https://ec.europa.eu/consumers/odr/.

12. Exclusion of warranties and liability

SYNAPSALE provides no warranties and shall not be liable, in any case, for damages of any nature that may be caused by:

• The lack of availability, maintenance and effective operation of the platform, or of its services and content, for reasons beyond its control.
• The presence of malware, malicious or harmful programs in the content.
• Unlawful, negligent, fraudulent use or use contrary to these legal terms and conditions.
• The lack of lawfulness, quality, reliability, usefulness and availability of services provided by third parties made available to users.
• Damages that may arise from illegal or improper use of the platform.

13. Suspension of services

SYNAPSALE reserves the right to suspend, modify or interrupt, temporarily or permanently, access to, browsing of and use of the platform, with or without prior notice depending on the urgency of the situation, and without users being entitled to claim any compensation. SYNAPSALE shall not be responsible for the consequences resulting from the lack of availability of the platform due to maintenance or update work.

If the suspension is due to maintenance work necessary for the proper functioning of the platform, users will be informed in advance so that they may adopt the necessary measures and avoid any damage or harm.

If the urgency of the situation prevents prior notice of the suspension of the service, notice will be given as soon as possible.

14. General matters

The temporal validity of these legal terms and conditions coincides with their time of publication and shall remain in force until they are modified in whole or in part, at which time the new published terms shall apply.

SYNAPSALE shall notify the competent authorities of any infringement of applicable legislation that may be detected or any suspicion of the commission of an offense.

If any specific part of the legal terms and conditions included herein were declared null and void or unenforceable by any competent court, tribunal or administration, such nullity or unenforceability shall not affect the remaining provisions of this Legal Notice.

15. Governing law and jurisdiction

The relationships between SYNAPSALE and the users of its telematic services present on this platform are subject to Spanish law and jurisdiction and to the courts of the province of Valencia, unless applicable law provides otherwise.
